THC Blood Limit (Driving)
A comprehensive, highly detailed intelligence report regarding the enforcement of the German Cannabis Act (CanG) as of April 2024. This exclusive dossier is specifically tailored to the topography of Freiburg im Breisgau, the strict protocols of the Baden-Württemberg police, and local transit infrastructure.
Understanding the federal baseline is mandatory before moving through Freiburg. Since April 1, 2024, the German Cannabis Act (CanG) partially decriminalized cannabis for adults aged 18 and over. You are legally permitted to carry a maximum of 25 grams of dried cannabis in public spaces. In your private residence within Freiburg, you may store up to 50 grams and cultivate a maximum of three female flowering plants per adult.
Do not let Freiburg's reputation as a "Green City" or its alternative local politics deceive you. The state of Baden-Württemberg (BW) is notoriously strict regarding law enforcement. The local Polizeipräsidium Freiburg enforces the federal limits to the exact gram. Exceeding the 25g public limit, even slightly, transitions the interaction from a simple confiscation to a severe administrative offense (Ordnungswidrigkeit) or a criminal charge with heavy fines.
Furthermore, the commercial sale of cannabis remains strictly prohibited. Sharing among adults is only tolerated if it occurs instantly and completely free of charge (no exchange of money, goods, or services). The black market is heavily targeted by plainclothes officers, particularly around major transit hubs.
The historic city center (Altstadt), famous for its Freiburger Münster and the small water runnels (Bächle) paving the streets, is the primary commercial and tourist zone. Under the federal CanG, public consumption of cannabis is strictly prohibited in all pedestrian zones (Fußgängerzonen) between 07:00 and 20:00.
This rule effectively outlaws smoking while sitting by the Bächle in the main shopping streets (like Kaiser-Joseph-Straße or Rathausplatz) during the day. The local public order office (Ordnungsamt) aggressively patrols these areas to maintain the city's pristine image for tourists. Fines for consumption in a pedestrian zone during prohibited hours can reach several hundred euros.
After 20:00, the pedestrian zone restriction lifts, but you must still adhere to the fundamental proximity rules: no consumption within a 100-meter radius of any schools, youth centers, or children's playgrounds, which are scattered throughout the inner city.
Seepark: Located in Betzenhausen, the Seepark is the ultimate gathering spot for Freiburg's massive student population (Albert-Ludwigs-Universität). While it is generally a tolerant environment, it is riddled with legal traps. The park contains a large playground, a mini-golf course, and sports facilities. You must maintain a visually verifiable 100-meter distance from the entrance of these specific facilities. Consuming on the main lawns away from the sports areas is generally legal for adults, but the police often conduct evening patrols to break up large, noisy gatherings.
Quartier Vauban: Known internationally as a model eco-district, Vauban has a very alternative, relaxed, and anti-authoritarian vibe. However, it is also a highly residential area with the highest density of children and daycares (Kitas) in the city. The 100-meter exclusion zone around Kitas and playgrounds makes almost the entire Vauban district a legal minefield during the day. Do not let the relaxed local culture lure you into a federal violation.
The Border Threat: Freiburg is situated in the Dreiländereck (the triangle between Germany, France, and Switzerland). Exporting or importing cannabis across these borders is a severe federal crime. While cannabis is decriminalized in Germany, if you take the train to Basel (Switzerland) or cross the Rhine into Alsace (France) with any amount of cannabis, you face immediate arrest for international drug smuggling by the Bundespolizei or French/Swiss customs (Zoll). The border checks have intensified since the CanG was passed.
Motorized Transit (B31 & A5): The B31 highway cuts directly through Freiburg, connecting the Black Forest to the A5 autobahn. German traffic law is draconian. The legal limit for driving is strictly set at 3.5 ng/ml of THC blood serum.
Freiburg police utilize highly accurate saliva swab tests at checkpoints. A positive swab results in an immediate, mandatory blood draw. Exceeding the 3.5 ng/ml limit triggers a one-month driving ban, a €500 fine, and potentially the dreaded Medical Psychological Assessment (MPU, or Idiotentest). The MPU is designed to be extremely difficult to pass and can cost thousands of euros to regain your driving privileges. Never drive under the influence.
